The Chair may levy and collect appropriate civil fines, not to exceed $25,000 per violation, against a tribe, a tribal regulatory body, or a management contractor engaged in gaming for any violation of any provision of this Act, 25 U.S.C. However, the Chair has the discretion to take an enforcement action without first issuing a Letter of Concern. Enforcement actions will occur only after a process of training and technical assistance has failed to result in compliance, and a Letter of Concern has provided notice that an NOV may be issued.
The Chair has the authority to issue Notices of Violations (NOVs), Orders of Temporary Closure (COs), Civil Fine Assessments (CFAs), and enter into Settlement Agreements (SAs) with members of the regulated industry for violations relating to the Indian Gaming Regulatory Act (IGRA), its implementing regulations, and tribal gaming ordinances.
